Why Brazil’s New Product Certification Rules Matter

On August 1, 2025, Brazil’s National Telecommunications Agency (Anatel) introduced sweeping changes through Resolution No. 780, modernizing the product certification rules for telecommunications equipment. This update reshapes Brazil’s conformity assessment framework and imposes new responsibilities on digital marketplaces while setting compliance obligations for data centers in telecom networks.

Marketplaces Now Held Liable

Anatel now holds digital marketplaces accountable within the regulatory chain. Under the updated rules, online platforms must ensure that all listed telecommunications products are certified and meet Brazilian standards.

These platforms must display valid Anatel approval codes in advertisements and verify product compliance before allowing listings. Moreover, Anatel can now penalize both sellers and marketplaces for any violations, including promoting uncertified products or misusing approval codes.

By clearly assigning shared liability, Anatel enhances consumer protection, strengthens regulatory enforcement, and helps curb the sale of non-compliant telecom devices online.

New Regulations for Data Centers

For the first time, Anatel extends its certification framework to include data centers that support telecom networks. Operators must catalog, classify, and undergo a conformity assessment for data centers before they begin operations.

Additionally, these centers must meet standards for resilience, cybersecurity, physical security, energy efficiency, and sustainability. Within 240 days, Anatel will publish the operational procedures detailing these requirements. Existing data centers will have three years to comply with the new rules.

This initiative recognizes the critical role of infrastructure in cloud computing, AI, 5G, and future networks—ensuring robust, secure, and sustainable systems across Brazil.

Effective Date and Transition Period

Resolution No. 780/2025 will take effect 180 days after its publication. Meanwhile, stakeholders can use this transition period to prepare for the upcoming enforcement. Furthermore, Anatel is expected to release additional rules and procedures soon.
