Mexico: Public Consultation on the Draft Agreement for Reclassifying the 64-71 GHz Band as Free Spectrum and Establishing Technical Operating Conditions

The Federal Telecommunications Institute (IFT), recognizing the importance of transparency in the development of new regulations, invites comments, opinions, and contributions from interested parties regarding the draft “Agreement by which the IFT classifies the 64-71 GHz frequency band as unlicensed spectrum and establishes technical operating conditions for the band” (hereinafter, the “Draft”). This proposal is based on various articles of the Federal Telecommunications and Broadcasting Law and the IFT’s Organic Statute, as well as the IFT’s Public Consultation and Regulatory Impact Analysis Guidelines.

The main objectives of the Draft are: (i) to classify the 64-71 GHz frequency band as unlicensed spectrum; (ii) to promote efficient use of the radio spectrum in this band by establishing technical operating conditions, thereby enabling public access to new technologies; (iii) to harmonize the use of the radio spectrum in line with international best practices and technological advancements; and (iv) to encourage technological innovation in Mexico by enabling access to the 64-71 GHz frequency band for new equipment or technologies without requiring a concession, thereby fostering competition in the telecommunications market.

This Public Consultation aims to provide transparency and inform the public about the proposed regulation, its regulatory impact analysis, and a reference document titled “64-71 GHz Frequency Band.” The reference document is not under consultation but is provided to help stakeholders better understand the IFT’s proposed measures and to offer feedback that could strengthen the regulatory proposal and refine the potential impacts if implemented.
