On March 7, 2018, the government of Mexico released a new official draft for Mexican standard PROY-NOM-184-SCFI-2017 regarding the regulatory elements and obligations that providers must consider for the commercialization or provision of telecommunications services when using a public telecommunications network. These changes have been considered to protect consumers rights and in order to provide the right information and elements. Among the main changes that providers of telecommunication services must implement, we can find the following modifications in the terms of guarantee of terminal equipments:
● The terms of guarantee should not be for less than 90 (ninety) days from the delivery of the Telecommunications Terminal Equipment.
● The time for revision or repair by guarantee should not be discounted from the original.
● Guarantees must be in Spanish and must be printed in typographic characters, including a required minimum information provided in the standard (name, manufacturer address, model ID, brand, guarantee duration, procedures to make effective the guarantee and exceptions, places where consumers can find components or accessories and others).
● The provider of telecommunications services or the one that offers the guarantee, should provide a voucher with the information about the repairs and also information about the time that repairs lasted.
● Detailed information about these changes can be found on Chapter 11 of the draft standard.
This norm will come into force once published in the official gazette of the Federation as a final rule, and set to replace NOM-184-SCFI-2012.
