MEXICO: IFT Updates Conformity Assessment Procedure “PEC” for Telecom and Broadcasting Products

On December 27th, IFT published the adjustment to the PEC (Conformity Assessment Procedure).  This is applicable to the Products intended for telecommunications or broadcasting, and connected to a telecommunications network, or using the radioelectric spectrum. These adjustments or new procedures were established as a result of the previous public consultation the Authority ran in April and will enter into force on June 27th, 2022, granting a transition period of 180 days after its publication.

Some of their main changes are the following:

-It included or adjusted some terms definitions, like importer, group of products with IoT functionality, Lot, not-new product, refurbished, rebuilt, and second-hand product.
-The certificate owner will have the opportunity to include in the certification not only its affiliates and subsidiaries but also its importers to use the certificate. In this sense, the importers won’t need to get their own certificates as it has to be under the current procedure.
-The quantity of the samples could be reduced from two to only one unit unless a specific technical case would require it.
-The test reports validity is being extended from 90 to 120 days from the issuance date. Trying to respect the manufacturer’s confidentiality, the Regulator has decided that the test reports are not a mandatory requirement to be included in the application folder submitted to IFT, but only upon the Authority’s request just for specific cases.
-The process of the extension of the Certificate of Conformity in the “Sample by Product Model and Surveillance for more than one Lot” scheme, would be just a documentary analysis, so the certificate holder would declare that the batch further contains one certain number of products, the which are of the same brand and model.
-The rebuilt, second hand or not new products, are now subject to this Assessment conformity.

The Certificates of Conformity issued by the Certification Body prior to the entry into force of this Agreement will maintain their validity in the terms in which they were issued to the holder and they cannot be extended or modified after June 2022.
