EUROPEAN UNION: Cybersecurity Delegated Regulation Supplementing of Directive 2014/53/EU Has Been Published

On Jan 12th, 2022, the expected Commission Delegated Regulation (2022/30) was published in the Official Journal of the European Union. This new regulation supplements Directive 2014/53/EU with regard to the application of the essential requirements referred to in Article 3(3), points (d), (e) and (f), of that Directive.

The Radio Equipment Directive (RED) defines the requirements related to the efficient use of radio frequencies, electromagnetic compatibility, safety and health. With the introduction of the new regulation, there will be new requirements for telecom and wireless equipment in relation to cybersecurity.

The Article 3(3), points (d), (e) and (f) is defined and applied as follows:

  1. d) Radio equipment does not harm the network or its functioning nor misuse

network resources, thereby causing an unacceptable degradation of service

  1. e) Radio equipment incorporates safeguards to ensure that the personal data

and privacy of the user and of the subscriber are protected

  1. f) Radio equipment supports certain features ensuring protection from fraud

The regulation entered into force last Feb 1st and there is a 30-month transition period, being mandatory from August 1st, 2024.

Currently, the development of the standards by the different parties is under process and we hope to see draft standards in 2022. But there is not yet any harmonization and therefore, no accredited testing is available.

Finally, there is time to be prepared but time goes by quickly, so we encourage all manufacturers to start preparing for what comes next.
