ANATEL has published on Feb 26th, the public consultation for the update of the attributions and destinations of Frequencies Brazil, the approved version of the document will serve as a guide for the next years regulations regarding the use of the Electromagnetic Spectrum in national territory.
Some relevant changes are described below and include some acts and resolutions to be revoked due to previous updates.
Art. 3 Repeal the following resolutions and provisions, which provide for the allocation, destination and/or conditions of use of radio frequency bands:
I – Resolution No. 527, of April 8, 2009, which approves the Regulation on Conditions for the Use of Radio Frequencies by Broadband Systems through Electricity Networks;
II – Resolution No. 628, of December 6, 2013, which approves the Regulation on Conditions for the Use of Radio Frequencies in the Band from 450 MHz to 470 MHz, by Private Limited Service within the Scope of National Airports;
III – Resolution No. 710, of May 28, 2019, which approves the allocation of the 2.3 GHz radio frequency band to the Private Limited Service – SLP and the Regulation on Conditions of Use of the 2.3 GHz Radio Frequency Band;
IV – Resolution No. 711, of May 28, 2019, which allocates radio frequency bands and approves the Regulation on Conditions of Use of the 3.5 GHz Radio Frequency Band;
V – Resolution No. 742, of March 1, 2021, which amends Resolution No. 711, of May 28, 2019, published in the Official Gazette of the Union – DOU of May 29, 2019, and the Regulation on Conditions of Use of Radio Frequency Band of 3.5 GHz attached to it, as well as approving the Regulation on Conditions of Use of the Radio Frequency Band of 24.25 GHz to 27.90 GHz;

Art. 4 Repeal Resolution No. 759, of January 19, 2023, which approves the Plan for Allocation, Destination and Distribution of Frequency Bands in Brazil (PDFF), promoting the attributions, destinations and specific conditions for the use of radio frequency bands arranged in it.
The public consultation is open until April 04th, 2024.
