Brazil Data Center Regulation Open for Public Comment
The National Telecommunications Agency (Anatel) in Brazil has launched Public Consultation No. 48/2025. This initiative introduces a proposed framework of technical requirements and operational procedures for the conformity assessment and homologation of data centers that are integrated into telecommunications networks (DCTCs). The Brazil data center regulation signals a significant shift in telecom infrastructure compliance.

Brazil Data Center Regulation: Scope and Infrastructure Coverage
The proposed regulation targets data centers that:
- Host core telecom systems.
- Store service-related operational and user data.
- Execute network functions supporting telecom services.
However, the regulation excludes infrastructure focused solely on physical signal transduction or interconnection, such as PoPs or radio base stations.
Key Compliance Requirements Under the Brazil Data Center Regulation
To comply, operators must:
- Maintain a Descriptive Report containing technical, architectural, and operational documentation.
- Develop and update a Risk Analysis Policy covering cybersecurity, energy efficiency, continuity, and sustainability.
- Notify an authorized System Assessment Body (SAB) about any infrastructure or operational changes.
Moreover, DCTCs deployed after the regulation’s enforcement date that use GPUs must declare compliance with specific electromagnetic compatibility (EMC) emission standards.
Certification Options and Audit Flow
Operators can choose between two pathways:
- Complete an audit by a SAB, receive a certificate, and then submit the homologation request to Anatel.
- Submit equivalent valid certifications directly for homologation (e.g., ISO/IEC 27001, 22327, 14001, 50001).
Furthermore, approved facilities will undergo mandatory re-evaluation every three years. If inspections or market surveillance uncover non-compliance, Anatel may suspend the approval.
