On September 21st, 2020, ANATEL issues additional notations to the Ato no. 3151 (Technical Requirements for the Technical Assessment of conformity for Terminal Access Stations) and Ato no. 3152 (Technical Requirements for Conformity Assessment of Celular Mobile Devices).
The technical requirements were published based in the standard 3GPP TS 38.521-3 which does not include the possible multiple operation modes in the standard 3GPP TS 38.101-3 for 5G NSA devices.
In the Brazilian regulation was not foreseen the following “The development status of the test standard becomes evident when it is verified that, in the description of the test procedures, several dual connection combinations (E-UTRA/NR Dual Connectivity – ENDC) defined in the 3GPP TS 38.101-3 specifications and already implemented in terminals available in the global market”
As the industry still in the development of 5G terminals and the equipment for the conformity assessment, the laboratories do not have the capabilities to perform the testing for all ENDC combinations for 5G terminals.
For this reason, the applicant for the homologation will be required to present a statement that includes the following:
- Committing to submit additional test reports for ENDC combinations not tested in the original terminal certification to the extent that Anatel publish updates of its requirements referring to updated versions of the 3GPP TS 38.521-3 standard in which new EN-DC combinations are specified and parameterized
- Present the statement of commitment and the test reports in the time period that will be requested by ANATEL
The implications of not comply with these requirements will meet sanctions as stated in the regulation including but not limited to:
- The homologation certificate will be suspended
- If the complementary test fails, the certification will be suspended and collect from the market the terminal device
