BRAZIL: Act No. 4521 Regarding The Operational Procedure for Importing Telecommunications Products is in Force.

Anatel has launched Act No. 4521 regarding the operational procedure for importing telecommunications products which determine that Approval is a prerequisite for the use and marketing, in Brazil, of telecommunications products, with the need for approval prior to importation for those listed in the Reference List of Telecommunications Products, subject to the following hypotheses:

a) samples for testing purposes for conformity assessment;
b) non-radio-frequency emitting products, in transit or temporarily in the country, intended for demonstration, exhibition, a survey of characteristics, or other purposes.
c) products covered by authorizations for Temporary Use of Spectrum;
d) products covered by authorizations for Special Service for Scientific and Experimental Purposes; or
e) products imported for use or consumption in the industrialization of products to be exported, provided that they are admitted under a special customs regime instituted for this purpose.

Important notes:
1. The import of approved products for marketing purposes is only allowed to the applicant for approval or by an entity authorized by the applicant for approval.
2. The identification of the approval, characterized by the affixing or engraving of the identification seal of the ANATEL approval on the product, must be provided prior to its entry into the country, subject to the exceptions provided for in the Operating Procedure for Marking the Identification of Anatel Approval in Telecommunications Products.

The Act is in force and the operational procedure will be from December 21st of 2021.
