On August 29th Argentina approved the Resolution 237/2024. Wich aims to update and simplify the conformity assessment system, modernize the regulatory system for products and services within the Ministry of Economy of Argentina, promote greater alignment with international standards, and encourage a more efficient commercial environment. The reduction of regulatory complexity and the implementation of a more agile and transparent control system are expected to benefit both consumers and businesses with the following objectives and benefits:
Foreign Test report Usage: In the event that laboratory testing is required as a conformity assessment procedure, test reports issued by:
I. Laboratories accredited by the OAA, in the corresponding scope;
II. Foreign laboratories accredited by accreditation bodies that are party to multilateral recognition agreements subscribed by the OAA, in the corresponding scope;
III. Laboratories that comply with ISO/IEC 17025 in the aspects detailed below:
A. Suitability of available equipment;
B. suitability of technical personnel;
C. traceability of their measurements;
D. control of its environmental conditions; and
E. registration of the information corresponding to the tests.
Each technical regulation shall establish the validity of the test reports and the admitted modalities.
Annex to the Resolution: The approved framework is detailed in an annex (IF-2024-92799306-APN-DNRT#MEC), which is an integral part of the resolution.
Use of the TAD Platform: All processes and procedures related to conformity and certification must be conducted through the “Trámites a Distancia” (TAD) platform, as established by Decree N° 1.063/16. The digital platform facilitates process management, and future updates will be made as the digital system evolves.
Recognition of Existing Agreements: Certifications and recognition agreements between certification bodies within the country and abroad, established under previous norms and validated by the competent authority, will continue to be valid and applicable.
Change in Responsibility: The General Customs Directorate, previously responsible for documentary and physical control of technical regulations, will be exempt from this function. Control will be carried out according to the new guidelines established by the General Framework.
Revoked Norms: The resolution revokes several previous resolutions and provisions, such as Resolutions Nros. 799/99, 237/00, 197/04, 282/14, and 344/21, as well as Provisions Nros. 178/00 and 747/01. These were previous regulations now replaced by the new framework.
Implementation of the Resolution: The resolution will come into effect 30 days after its publication in the Official Gazette. The new compliance marking system will have a 90-day period to become applicable to already certified products.
