What’s changing under the new ANATEL import rules
Importation of Product Samples for Conformity Assessment
Under the new rules, importers may bring product samples into Brazil strictly for the purpose of conformity assessment testing. However, only the number of units required for testing will be released; any surplus will remain held until the final Certificate of Approval is issued.
Furthermore, release of samples requires a formal service agreement between the importer (or homologation holder) and an ANATEL‑designated Certification Body or authorized Testing Laboratory. The agreement must clearly specify product model, manufacturer, and the exact number of units to be evaluated. Even shipments via postal or express courier are subject to compliance verification by ANATEL and the Federal Revenue Service.
Importation of Products Approved for Commercialization
For devices already homologated, the updated regulation imposes stricter controls. Only the homologation holder — or their legally designated representative — may import approved telecommunications products into Brazil. Each item must display the official ANATEL approval seal according to the relevant marking procedures.
Additionally, import documentation (especially the DUIMP — Single Import Declaration) must include the product’s homologation code in the “Additional Information” field to secure proper customs processing and regulatory oversight.
When the rules take effect
These provisions will come into force on May 25, 2026. Importers and homologation holders should prepare now to ensure compliance by that date.
